Court Throws Out Menzgold Suit Against SEC And BoG

An Accra High Court has dismissed a suit brought by Menzgold challenging the regulatory powers of the Securities and Exchange Commission (SEC), which ordered the company to shut down an illegal operation.

The court, presided over by Mrs Justice Akua Amoah, threw out the suit following a preliminary legal objection raised by SEC and BoG.

BoG and SEC had argued that Menzgold failed to exhaust all the regulatory mechanism for redress before going to court.The court agreed with the two regulatory bodies and dismiss the suit.

In the September 2017 suit, Menzgold asked the court to declare that its “business does not fall within the present legislated scope of the Banks and Specialized Taking Institutions Act 2016 (930).”

The gold dealers also wanted a declaration that the directives by the two institutions were arbitrary, capricious and contrary to Article 23 and Article 296 of the 1992 Constitution.

Since then, the company has requested for an order setting aside the directives by the two institutions and for them to retract and apologise for the same.

Menzgold after the September 2017 order to shut down its gold trading, requested for sit down with SEC. But the regulator set some pre-conditions for the meeting asking Menzgold to produce some documents for the meeting.Menzgold rejected the conditions and went to court.

New Zealand Ex-Official Found Guilty Of Hiding A Camera Inside The Country’s Embassy Toilet In The US For Intimate Visual Recording

Alfred Keating, one of New Zealand’s former top-ranked military officials in the US, has been found guilty of planting a secret camera in a unisex bathroom at the country’s embassy in Washington DC.

The 59-year-old faces up to 18 months in prison for attempting to make an intimate visual recording.

According to BBC, Keating’s DNA matched traces found on the SD card in the camera, which appeared to have been in place for many months.

He will be sentenced on 25 June.

Keating was serving as a defense attache at New Zealand’s embassy in Washington when a small, covert camera was discovered in a unisex bathroom after it fell out of a hiding spot in a heating duct on 27 July 2017.

It was reported that the motion-activated camera was positioned to capture intimate video recordings of anyone using the toilet.

Crown prosecutor Henry Steele told the court that investigators began to suspect Keating after examining the buildings swipe card records, the New Zealand Herald reported.

CCTV footage also showed a man wearing dark trousers, a white shirt and a black Fitbit watch entering the toilets at around the same time the hidden camera was activated by a hand wearing a blue latex glove.

The police investigation found the device had been in place for some months because the homemade platform it was mounted on in the bathroom was covered in a thick layer of dust.

Kenya: Thieves Steal Guns As Police Watch Champions League

Police in Kenya have been left red-faced after thieves stole guns and ammunition from an unattended check-post as the officers on duty watched UEFA Champions League matches down the road.

Three rifles and nearly two dozen rounds were pinched from the check-post Tuesday evening in Nandi, in Kenya’s west, while the officers wandered off to watch Cristiano Ronaldo and Lionel Messi play in the UEFA quarter-finals on television at a nearby shopping mall.

“On returning… they noticed the room of the in-charge, which is also used as an armory in which the steel box is kept, was broken,” stated a police report into the incident seen by AFP.

A search was underway for the stolen firearms, the report added. It was not immediately clear if the officers faced disciplinary action.
